DMCA & Copyright Policy

Tloom is operated by Elavite Inc. We respect the intellectual property of others, and we ask everyone who uses our site to do the same. This policy explains how we respond to claims of copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Parts of our site display content submitted by users - product reviews, comments, and photos, for example. If you believe that material appearing on tloom.com infringes a copyright you own or control, you may ask us to remove it by following the process below.

Submitting a Takedown Notice

To be effective under 17 U.S.C. § 512(c)(3), your written notification must include substantially all of the following:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed - or, if a single notification covers multiple works at a single online site, a representative list of those works.
Identification of the material that is claimed to be infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, together with information reasonably sufficient to permit us to locate the material - a direct URL is best.
Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and, if available, an email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please be aware that under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages. If you are unsure whether material infringes your copyright, consider consulting an attorney before submitting a notice.

Designated Copyright Agent

What Happens Next

When we receive a valid notice, we will remove or disable access to the identified material promptly, and we will make a reasonable effort to notify the user who posted it.

Counter-Notice Procedure

If material you posted was removed and you believe the removal was a mistake or misidentification, you may send our designated agent a written counter-notice under 17 U.S.C. § 512(g)(3) that includes:

Your physical or electronic signature.
Identification of the material that was removed or disabled and the location at which it appeared before removal.
A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the United States District Court for the Southern District of Florida), and that you will accept service of process from the person who provided the original notice or that person's agent.

After we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant notifies us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material within 10 to 14 business days of receiving the counter-notice.

Repeat Infringers

We will, in appropriate circumstances, terminate the accounts and site privileges of users who are determined to be repeat infringers, and we reserve the right to remove any submitted content at our discretion.
